Terms & Conditions Below are the terms and conditions on which we Jenny McLaughlin and Bodybetter Kids Physiotherapy provide physiotherapy services (the “Services”)

The exact services or treatments we will provide to you will depend on what we agree following the result of your child’s initial assessment.

Before you agree that we will provide Services and/or carry out the Initial Assessment, please read the terms and conditions. 

If you have questions concerning them please ask before entering into an agreement with us to provide physiotherapy Services.

 

Initial Assessment

Before we provide any Services, we shall perform an initial assessment of the child’s needs and requirements ('Initial Assessment').  An Initial Assessment will be child centred and will vary according to the child’s needs. It is the policy of Bodybetter Kids Physiotherapy to reduce conversations about a child’s medical history with the child present and so there may be the need for time to be spent gathering information before the first session.

Commonly the initial assessment could include:

  • A pre assessment questionnaire or phone conversation
  • A discussion of the child’s needs
  • An evaluation of the child’s physical needs,
  • Developing a treatment plan around physical goals
  • Liaison with other health professionals or teachers   

An Initial Assessment takes between 60 and 90 minutes. In cases where the initial assessment reveals a condition which does not require the services of Bodybetter Kids Physiotherapy this will be explained and an alternative course of action recommended. 

 

 Performance of the Services

We will provide you with the Services only after an Initial Assessment has been carried out. If treatment occurs over several sessions ongoing reassessment will be required during treatment sessions.

 

Outcomes

It is not possible for any particular result or outcome to be guaranteed as a result of us providing the Services. Our aim is to provide the Services using reasonable care and skill. We will regularly reassess the child’s treatment plan in collaboration with parents and or carers. We shall seek to enable you to achieve the desired outcomes for your child. No outcome can be guaranteed, however, and you have sole responsibility for acting on any recommendations or advice we may give.

 

Sessions

If we have not agreed the number of sessions to be provided, we shall provide sessions on a session-by-session basis.

We will agree the date and time of the first session and any subsequent sessions by telephone, in person or by e-mail.

 

School sessions and home visits

Bodybetter Kids Physiotherapy Services for home and school visits include, collection from the clinic of suitable equipment for the session, signing in and signing out time at school, liaison and discussion and training of teaching staff and or parents, travel time and liaison with parents if they have been unable to attend the session. Costs and timing for a session are quoted to include these Services and are not quoted according to the time spent on direct physiotherapy.  

Travel time for school visits and home visits is charged as per the hourly fee rate for time spent travelling and 45p per mile expenses.

Regular sessions at school can be arranged according to the school timetable if the session is available from an Associate of Bodybetter Kids Physiotherapy. A commitment to a fixed session cannot be guaranteed for a school term, or year. Continuity will be offered as far as possible. The cancellation of two sessions which are planned on school timetable in one term regardless of notice given may mean that this session no longer remains available.

No more than six sessions of Our Services can be offered in a school to a child without a parent or carer being present and all sessions at school are undertaken with a teaching assistant present.    

 

Exercise programs, task practice or hands on skills

We may train you in the delivery of various exercises, tasks and hands on techniques with your child. You are not obliged to complete these, but if you do not then the effects of the direct services delivered by us may not be carried over between sessions. The progress in achieving the desired outcomes and effects of our services may be slowed down or negated if the home exercise advice or guidance is not followed.

 

Costs of Sessions and Payment of Fees

Our fees for each session will be as confirmed by us to you. These fees as of April 2016 are £70.00 per hour. You are personally liable to pay all of our fees and any surcharges incurred, such as any cancellation fees. We are happy to accept you as a client if you are arranging to pay through a third party, such as via any form of insurance or via a charity. However it is your responsibility to check with that third party whether they have to pay any excess and how much treatment they will pay for, as you will be liable for any payment they do not make.

 

Payment and Cancellation

We accept payment by cash, cheque or bank transfer. Payment must be made within 10 days of the submission of our invoice.

If you are late arriving at a session, the session will begin on your arrival and continue until the time when it is scheduled to end. If you wish the session to overrun, and we agree, then you may be charged at our discretion for the extra time we spend in providing the Services. 

If a session has been booked and you cancel with less than 24 hours' notice or do not turn up for the session, then you are liable to pay the cost of that session. Please be aware that, in many cases, insurance companies will not pay our fees if you have not turned up or cancelled with less than 24 hours' notice and as is the case above, if your insurance company will not pay, you will be liable for such payment.

On occasion, we may have to cancel a scheduled session. This may occur, for example, if a staff member is sick or if a preceding session has overrun because of the health needs of a child. If we have to cancel a scheduled session, we will book you another appointment at a mutually convenient time as soon as reasonably possible. No charge will be made to you for any sessions which may be cancelled by us.

 

Confidentiality

We shall not disclose such information to any third party without your prior permission, except where required by law or where action might be necessary to protect you, your child or someone else.

 

Consent

Bodybetter Kids Physiotherapy requires all parents or carers to sign a consent form for Our Services and for liaison in the child’s best interests with other professionals involved in their care, prior to the assessment. Separate consent forms may be needed for certain Services.

 

Liability and Exclusions

We have no liability for any loss incurred by you, whether financial or otherwise, following our provision of the Services, nor for any perceived failure by you, whether justified or otherwise, to achieve your desired outcomes or goals.

Our liability to compensate you for any loss or damage is limited to a reasonable amount (and not exceeding the amount you pay in total for the Services), having regard to such factors as whether the damage was due to a negligent act or omission by us

We shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or for any indirect or consequential loss arising under or in connection with the Services. Except as set out in these conditions, all warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from the contract. This clause will survive the termination of the contract.

 

Indemnity

You agree that you will indemnify us against any and all loss or damage suffered, including any legal fees or costs, as a result of any breach of this agreement by you.

 

Variation

We may change any of these terms or conditions, including our fees.

In exceptional circumstances, such as illness or other commitments, inappropriate behaviour by you, refusal for your child to be treated in a reasonable way, actual or potential conflict of interest, non payment of invoices, or other reasons, we may decide to terminate the Services early and or refuse or be unable to provide further sessions to you. In such circumstances, we shall give you notice of termination and will refund to you any advance payment made for sessions not yet provided.

 

Severance and Events out of our Control

If a court or any other competent authority finds that any provision of this contract (or any part of any provision) is invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed deleted and the validity and enforceability of the other provisions of the contract will not be affected.

We will not be liable to you as a result of any delay or failure to perform our obligations under this contract as a result of any event beyond our control including but not limited to, strikes, lock-outs or other industrial disputes, failure of a utility service or transport network, act of God, fire, flood or storm or breakdown of machinery.

Disputes and Governing Law

Bodybetter Kids physiotherapy works within the highest standards of respect and with the ethos that kids want to have fun and enjoy their physiotherapy. The Bodybetter Kids complaints policy is to address any difficulty directly and in conversation and if you are unhappy with any aspect of our services we would encourage you to have a conversation with the practitioner who sees your child. If this is not resolved to your satisfaction or fails to address the issue, you can put your compliant in writing so that an investigation can be undertaken.

This agreement is governed and construed by English law and the parties submit to the jurisdiction of the courts of England and Wales.
